HOUSE RULES

 

Through the use of your membership, Members, Guests and Visitors agree to be bound by the House Rules.

 

 

Membership Allowances

Each tier of membership at Nasab comes with unique facilities, benefits and access. It is expected that Members are fully aware of and respect their specific memberships allowances. Penalties and fees will be automatically applied to the accounts of Members who exceed the access allowances granted by their memberships.

 

 

Orientation

You will be required to attend a one-time orientation. During the orientation you will be introduced to the space and all elements of the IT and facility benefits included in your membership.  Suite members will also be shown an inventory of all décor and furniture under your membership responsibility.  Members must attend the orientation prior to using the Premises, Facilities or enjoying the membership benefits and in any event within two weeks of your membership being activated.

 

Code of Conduct

 

Nasab is a private members club and it is expected that the conduct of all Members and their Guests and Visitors reflects the refined standards of the club at all times and including without limitation in their interactions with other members and staff as well as in the use of the Facilities.  The Nasab Manager reserves the right to penalize or expel Members and/or their Guests or Visitors whose actions are deemed to violate the standards of the club.

Through the shared working environment Members may be exposed to private events and acquire confidential information regarding the activities of other Members that is not explicitly intended for them (Confidential Information). It is expected that all Members respect the privacy and intellectual property of other Members, Guests and Visitors (including Nasab personnel) and must not disclose any Confidential Information to any third party.

 

From time to time the Nasab Manager will carry out member activities and events that have a strict no press or social media policy. Members will be informed of such events and policies in advance and will be held accountable if such content is disclosed.

 

The Nasab Manager reserves the right to terminate the memberships of any Member who is found to violate the confidentiality of other Members or Guests or Visitors or of Nasab Manager.

 

 

Payments & Fees

 

Upon acceptance of your membership a one-time initiation fee of AED500 is payable immediately. A Security Deposit and the first month’s membership fees must be paid on the first day of the membership. Monthly membership fees are payable one month in advance on the last business day of each month. A late payment fee of AED150 applies to any invoice that exceeds 5 days overdue. Nasab reserves the right to terminate memberships where monthly fees are more than 12 days overdue.

 

Nasab is a strictly members only venue. Members must register any Guests or Visitors identifying the purpose of their attendance at the Premises in order for them to be granted access. Registration of Guests is only through the Nasab app.

 

Guests: Guests have full access to the benefits and Facilities included in the membership of their Host Member. Subject to availability, additional Guest access, up to five Guests per month, can be purchased at a rate of AED200 per Guest. A maximum of two Guests can be hosted at any one time. A Member’s Guest will not be granted access to the Premises without the Member being present and cannot remain at the Premises if the Member leaves.

 

Visitors: Members are permitted to invite additional Visitors into Nasab for the purposes of business meetings within Nasab’s designated meeting spaces. Members must book their meeting space in advance and visitors will only be granted access if linked to a registered meeting. The number of attendees to any meeting cannot exceed the given capacity of the booked meeting space.  Visitors are permitted access to Nasab for the sole purpose of their meeting and, with the exception of visiting the washrooms and F&B outlets, do not have access to any other facility or locations outside of the booked meeting space.

 

Members shall procure that their Guests and Visitors comply with the House Rules and the Member will be penalized should his or her Guests and/or Visitors violate any House Rule.

 

 

Noise

 

Music, sounds, presentations or any other audio that will disrupt members around you must be played through headphones and must not be audible to any other Members, Guests or Visitors. Open shared working areas within Nasab are quiet zones, and Members should use the designation communal meeting areas for networking and interactions with other Members.  Phone calls and conference calls must take place in the designated phone booths or meeting rooms. The Nasab community management team at their complete discretion can decide whether noise may be disruptive to the wider community and inform the Member according.

 

Food & Beverage

 

Bringing external food and beverage into Nasab is not encouraged as it can be a disruption to other Members, Guests and Visitors and the working environment.

 

 

Use of Equipment & Facilities

 

Use of the leisure facilities, including pools, spa, Gym and fitness facilities are entirely at the risk of the Member and their Guests. Each Member will be provided an introductory session on safe use of equipment in the fitness facilities. It is the responsibility of the Member and their Guests to ensure they are competent and safe to use any equipment provided. Any accidents or injuries should be reported immediately to the Nasab Manager.

 

Use of photography or event space requires adherence to the terms and conditions of the respective areas. Members will be asked to agree to these terms before any booking is made.

 

 

 

 

Closed events and maintenance

 

From time to time, the Nasab Manager reserves the right to close off parts of the space for private events. During these times the Nasab Manager will use all reasonable endeavors to limit disruption to the working environment of Members. Where practicable, advance notice of such events will be provided to Members

 

Nasab Property

 

All items owned by the Nasab Manager, including without limitation books, furnishings, cutlery and crockery etc. remains the sole property of the Nasab Manager and must not be removed from the Premises. Any damage to the Premises, Property or Facilities must be paid for by the Member who caused the damage or who hosted the Visitor or Guest who caused the damage.

 

Pets

 

Nasab is a pet friendly zone (with the exception of the exclusion areas), however the Member must ensure that they and their pet comply with the Pet Policy including that their pet must not disrupt the working environment or personal sensitivities of any other Members, Guests or Visitors. The Member is fully responsible for maintaining the cleanliness of any areas in which their pet is located.

 

Pet exclusion zones include the Pantry, Bathrooms, Gym, Spa, Meeting rooms and any Suite not included in your membership (the Nasab Manager reserves the right to change the pet exclusion zones at any time and deny access or expel any pet that is deemed to be disruptive to the Nasab environment).

 

Alterations

 

The Nasab Manager provides a fully furnished work environment both in common areas and Suites. Any alterations or additions to décor are not allowed. The Nasab Manager reserves the right to remove, at full cost to the Member, any changes that have not been granted prior approval.

 

Liability

 

The Nasab Manager is not responsible for nor shall be held liable for any loss or damage to items that belong to or in the possession of the Member, Visitors or any Guests that are held or kept at the Premises or Facilities. Such responsibility remains with the Member.

 

 

Bookings

 

The use of meeting rooms, shared computers, photography studio and fitness and spa facilities are only available via advance booking and payment. Members must respect their allocated time allowances to ensure fair usage to all members.

 

 

Enquiries & Helpdesk

 

We want your experience at Nasab to be as seamless and efficient as possible and that is why we have established the Helpdesk section on the Nasab app. The Helpdesk is the first point of reference for any enquiry related to IT, housekeeping, booking changes and other general enquiries. Members should submit any enquiry through the Nasab app to ensure that their query can be dealt with as quickly and efficiently as possible.

Reception Services

 

As part of our services, Nasab Animators desk can accept non-perishable deliveries (for example post and dry cleaning) on behalf of Members, however the Nasab Manager can only hold items for a maximum of 24 hours, after such time we reserve the right to dispose of deliveries. The Nasab Manager cannot take delivery of perishable items. If a Member would like to avail of the Reception Services please contact the Nasab Community Team through the Nasab App for further information. We cannot accept delivery of items unless the Member has first registered for our Reception Desk Services.

 

Smoking Policy

 

Smoking including cigars, pipes, vaping, e cigarettes and shisha inside the Premises or Facilities is not permitted at any time. The Nasab Manager has designated smoking areas outside the building which are subject to change at any time.

 

Amendments to the House Rules

 

The Nasab Manager reserves the right to change the House Rules from time to time. Members will be notified in advance should any changes occur, and the most current version of the House Rules will be available on request from the Nasab community management team. By using the Nasab facilities Members, their Guests and Visitors agree to be bound by and follow the House Rules.

 

 

TERMS & CONDITIONS

 

The following terms used in this Agreement shall have the meanings set out below:

 

  1. “Agreement” means the Membership Agreement comprising of the Membership Plan, the House Rules and the Terms & Conditions
  2. “Facilities” means the communal areas within Nasab, the main swimming pool, the children’s swimming pool, the rooftop swimming pool, the rooftop lounge, the Gymnasium and the hammams and saunas
  3. “F&B outlets” means any food and beverage venue on the KOA Canvas Community
  4. “Guest” means a person who may accompany a Host Member onto the Premises and who may use the Facilities in accordance with the Host Member’s Membership Plan
  5. “Group Entities” means the owner and affiliates of the Nasab Manager
  6. “Gym” means the gymnasium located on the first floor and the sports and fitness equipment contained therein but excluding the altitude fitness room and equipment therein
  7. “Host Member” means the Member under whose membership any permitted Guests and/or Visitors are entitled to be on all or part of the Premises as appropriate
  8. “House Rules” means the rules and policies as may change from time to time at the Nasab Manager’s sole discretion
  9. “Membership Plan” means the particular type of membership and the benefits and access to the Facilities that are conferred on the Member in accordance with clause 2 and as set out on page 1
  10. “Nasab” means the Members only workspace and social club occupying part of the ground floor of the Nasab building including the shared work space, common areas, relaxed meeting rooms, pantries and washrooms, the Suites and management offices
  11. “Nasab App” means the application available on iPhone, Android or other devices from which a Member may access their membership account and make bookings for the use of the Facilities
  12. “Opening Hours” means 9am until 7pm or as extended by the Nasab Manager
  13. “Party” means the Nasab Manager or the Member as the context requires and Parties shall mean both
  14. “Premises” means Nasab and the wider KOA Canvas Community excluding the residential and restricted areas
  15. “Property” means any furniture (including without limitation chairs, tables, desks, shelves, sun loungers, lights and lamps), technological equipment (including without limitation the shared computers, screens, televisions, printers), artwork (including without limitation paintings and pictures, installations, statutes), kitchenware (including without limitation crockery, cutlery, glasses, cups etc), books, lockers, Gym and Spa equipment, and any other chattels, fixtures or fittings in, on or under the Premises
  16. “Security Deposit” means the amount payable by the Member shown in the Membership Payments table on page 1 of this Agreement as supplemented in accordance with this Agreement
  17. “Suite” means the room allocated to a Suite Membership for the Suite Member’s and Suite Users’ exclusive use
  18.  “Suite User” means a Member, Guest or Visitor who by virtue of the Membership Plan of the Suite Member may use the Suite Member’s allocated Suite
  19. “Terms and Conditions means these terms and conditions as amended from time to time at the sole discretion of the Nasab Manager.
  20. “Visitor” means a person who may accompany a Member to Nasab to utilize the specific meeting space which has been reserved for a registered meeting

 

MEMBERSHIP TYPES AND ALLOWANCES

 

  1. Membership contracts are for a period of either six (6) months or twelve (12) months. The applicable membership term is specified in the Membership Plan on page 1 of this Agreement.
  2. The Member agrees to pay the Membership fees as set out in the House Rules.

 

RESIDENT MEMBERSHIPS

 

  1. Resident memberships include access to the Premises and use of the Facilities (excluding the Suites and management offices) during operating hours including any desk space within the common working areas during the Opening Hours.

 

WELLNESS MEMBERSHIPS

 

  1. Wellness memberships include access to the Premises and use of the Wellness Facilities (excluding the Suites, Management Offices and Office Services) areas from 6am to 10pm from Sunday -Saturday.
  2. Wellness memberships are eligible to use the Wellness Facilities, which include the fitness studio, spa facilities and services, padel and tennis court, high altitude studio, garden pool and lap pool.
  3. Members who exceed their access to the Office Facilities which include the access to any hot desk, printing services, meeting room services, will receive a warning from Management for a breach of the contract that will then result in the membership contract termination by Nasab.

 

CONSULTANT MEMBERSHIPS

 

  1. Consultant memberships include access to the Premises and use of the Office Facilities (excluding the Suites, Management Offices and Wellness Facilities) during operating hours including any desk space within the common working areas.
  2. Guest passes purchased by the paying member for the Consultant member can only access Nasab during the operational hours from 9am to 7pm, Sunday to Saturday.
  3. Consultant memberships can access any available hot desk, pantries, printing services and meeting room services.
  4. Members who exceed their access to the Wellness Facilities which include the fitness studio, spa facilities and services, padel and tennis court, high altitude studio, garden pool and lap pool; will receive a warning from the Nasab Management for a breach of the contract that will then result in the membership contract termination by Nasab.

NOMAD MEMBERSHIPS

 

  1. Nomad memberships are available to non-Dubai residents only. Applicants must provide proof of residential address before a Nomad membership will be activated.
  2. A Nomad membership includes access to the Premises and use of the Facilities (excluding the Suites and management offices) during operating hours for 10 days per calendar month.
  3. Members who exceed their monthly access will be automatically charged at the then current day pass rate for each day in excess of their monthly access.

 

CANVAS MEMBERSHIPS

 

  1. Canvas memberships include access to the Premises and use of the Facilities during operating hours including any desk space within the common working areas during the Opening Hours.
  2. Canvas memberships can access any available hot desk, but the Nasab Manager cannot be held responsible if hot desks are not available.

 

SUITE MEMBERSHIPS

 

  1. Suite memberships are comprised of the Suite Member and Suite Users. The total number of Suite Users allocated to a Suite Membership cannot exceed the total number of seats in the Suite as per the Suite Inventory.
  2. Only the Suite Users explicitly named in the Membership Plan section on page 1 of this Agreement will be granted access to the Premises and use of the Facilities (excluding the other Suites and management offices) during operating hours under the given Suite membership. Revisions to the list of Suite Users during the membership duration is at the discretion of the Nasab Manager.
  3. Membership fees and charges for office services and amenities related to the Suite incurred by any Suite User will be invoiced to the account of the Suite Member. Suite Users will be billed directly for charges related to wellness facilities.

 

ADDITIONAL MEMBERSHIPS

  1. Nasab reserves the right to create new memberships and/or passes at anytime. Examples of such memberships include but are not limited to: “Drop-In”, “On-Demand HQ”, “Executive HQ” and “Leisure Pass”
  2. Any new memberships and / or passes created by Nasab are bound by the house rules and terms & conditions outlined in this document.

 

MEMBERSHIP PAYMENTS AND CHARGES

 

  1. A one-time initiation fee of AED500 applies to all memberships.
  2. Membership fees shall be paid in advance in monthly installments on the last business day of each month.
  3. If part or all of the membership fees are not received by the fifth day of the month an AED150 late payment fee will be charged on each occasion of late payment.
  4. If any amount of the membership fees remain unpaid for a period of twelve (12) days after the due date, the Nasab Manager is entitled to terminate the membership and/or to prohibit the Member from entering the Premises until payment in full including any late payment fees.
  5. The Member agrees to pay the charge of five hundred Dirhams (AED 500) for each cheque or unsuccessful transfer given or made by the Member to the Nasab Manager that is returned for lack of sufficient funds.

 

SECURITY DEPOSIT

 

  1. The Member shall pay to the Nasab Manager a Security Deposit the amount of which is specified in the Membership Payments on page 1 of this Agreement.
  2. The Security Deposit shall be paid by means of an undated cheque or via credit card payment on the day of orientation. Use of the Premises, Facilities and Property shall not be permitted until the Security Deposit is paid.
  3. The Nasab Manager may use all or part the Security Deposit to repair any damage to the Premises, Facilities or Property caused by the Member, the Member’s Guests or Visitors. In addition, the Nasab Manager shall be entitled to deduct any amounts as may be necessary for the removal of waste that the Member has allowed to accumulate. Further, the Nasab Manager is entitled to apply the Security Deposit to settle in full or in part any other amounts owed to the Nasab Manager for the Member’s breach of this Agreement. The Member will be held liable to fully pay any balance amount due if the charges exceed the value of the Security Deposit.  In the event that the Member’s Security Deposit is fully utilized and applied for the repair of damage or any other permitted purpose, the Member is required within seven (7) days of receiving notice to make a payment to the Nasab Manager to reinstate the Security Deposit to the amount set out in the Membership Payments table. The Nasab Manager is entitled to terminate the membership and/or to prohibit the Member from entering the Premises if the full payment is not made.
  1. The Member shall not be entitled to set-off, apply or deduct any portion of any Security Deposit from any month’s membership fees or any other fees or charges due from the Member or the Member’s Guests and/or Visitors. If the Member breaches any of the terms of this Agreement, the Member shall forfeit the Security Deposit.
  2. Within 30 days of the termination of the Membership and the Member paying all amounts owed to the Nasab Manager, the Nasab Manager shall return the Security Deposit (less any deductions) to the Member.

 

MEMBERSHIP RENEWAL & CANCELLATION

 

  1. If the Member chooses to terminate the Agreement before the end of the membership term the full membership fee is payable within 14 days of the Member providing notice of termination.
  2. The Member can terminate or apply to extend the Membership at the end of the membership term by providing fourteen (14) days written notice to the Nasab Manager. If the Member provides less than fourteen (14) days notice of termination a fee of AED500 will be incurred by the Member.
  3. At the expiration of a Suite Membership, the Member shall peaceably vacate the Suite returning the Suite and any Property in the same condition it was in at the commencement of the Membership (reasonable wear and tear expected).
  4. Suite Members will attend an inventory check-out day (“Check-out”) as set by the Nasab Manager, being no later than seven (7) days after the last day of the Membership.   During the Check-out, the Nasab Manager will go through the inventory and detail any missing or damaged items (“Damage”).  The Nasab Manager will assess and evaluate the Damage and provide the Member with the costs to be paid as soon as reasonably practicable.
  5. The Nasab Manager may deduct the costs of repairing the Damage from the Security Deposit. In case the costs of repairing the Damage is greater than the Security Deposit, the Member shall pay the balance within seven (7) days from the date the Nasab Manager notifies the Member of the costs due.
  6. The Nasab Manager will be entitled to terminate this Agreement on the following grounds:
    1. the Member fails to pay any outstanding membership fees despite receipt of 12 days’ notice from the Nasab Manager;
    2. the Member, the Member’s Guests or Visitors engage in any Illegal, immoral or unauthorised use of the Premises;
    3. a Suite Member purports to sublet or assigns a Suite;
    4. continued breach of the Member’s obligations as stated in the Agreement or applicable laws despite receipt of 30 days’ notice of the breach and request to take remedial action from the Nasab Manager.
  7. Should any of the circumstances set out in this clause 5.6 occur, this Agreement shall be terminated with immediate effect from the date of the notice to terminate and the Nasab Manager’s rights in respect of any breach of this Agreement remain reserved.

 

 

USE OF PREMISES

 

  1. The Member shall only use the Premises and Facilities for the purpose for which they are intended.
  2. The Premises and Facilities shall not be used for residential purposes or to carry out any retail or illegal or immoral activity.
  3. The Member will comply with all laws, rules, ordinances, statutes and orders regarding the use of the Premises and the Facilities.
  4. The Member shall not keep or have on or around the Premises or the Facilities any item of a dangerous, flammable or explosive nature that might unreasonably increase the risk of fire or explosion on or around the Premises or that might be considered hazardous by any responsible insurance company.
  5. The Member acknowledges that it is wholly and solely responsible for ensuring the Premises is suitable for its purpose and activities and shall not hold the Nasab Manager liable should any authority, ministry, department, or any governmental or quasi-governmental body (“Authorities”) deem that the Premises are not fit for the Member’s use or purpose, for whatever reason, including the issuing of residency visas.
  6. The Member waives all claims against Nasab for any costs or fees incurred by the Member including but not limited to any consequences arising from the non-acceptance by the Authorities of the Member’s Premises and/or Ejari Certificate issued by Nasab for whatever reason and shall not claim any monies (including membership fees or any extra fees) back from the Nasab Manager for whatever reason.
  7. Access to Nasab and the amenities within the Nasab building including the workspace, fitness studio, roof pool, photography studio are only permitted for members and guests over the age of 18. Access to the outdoor amenities such as the main pool, padel tennis court are permitted for all ages.

 

UTILITIES AND SERVICES

 

  1. Chiller (AC), DEWA, television, internet and other utilities (“Utilities”) are furnished as a part of this Membership unless otherwise indicated in this Agreement. These expenses are the responsibility of and shall be obtained at the expense of the Member and are included in the membership fees.
  2. Charges for photocopy facilities are not included in the Utilities and are payable through a credit system.
  3. Maintenance of the Utilities are included as a part of this Membership and shall be borne by the Nasab Manager.

 

ALTERATIONS

 

  1. The Member agrees not to make any improvements or alterations, additions, partitioning, painting or undertake any building works (“Alterations”) to the Premises, Facilities or Property.
  2. If any Alterations are made to or built on or around the Premises, the Nasab Manager has the option of either:
    1. such Alterations becoming the property of the Nasab Manager and shall remain at the expiration of the Membership; or
    2. removing the Alterations and carrying out any repair and the Member shall then be liable to immediately reimburse the Nasab Manager for all expenses incurred, as well as an additional ten percent (10%) of the cost of the expenses as an administration charge.

 

MAINTENANCE REPAIR AND DAMAGE TO THE PREMISES, FACILITIES AND PROPERTY

 

  1. The Member shall promptly and within 7 days notify the Nasab Manager of any damage, defect or destruction of the Premises, Facilities or Property. The Nasab Manager will use its best efforts to repair or rectify any such damage.
  2. The Nasab Manager will, at the Member’s expense, be responsible to make all repairs to the Premises, Facilities and Property that have been damaged (“Damaged Items”) by the Member’s, the Member’s Guests or Visitors use and/or misuse.
  3. If the Premises are damaged or destroyed by fire or other casualty not due to the Member’s negligence, the membership fees will be abated during the time that the Premises are unusable.
  4. If the Nasab Manager decides not to repair or rebuild the Premises, then the Agreement shall terminate, and the membership fees shall be prorated up to the time of the damage. Any unearned membership fees paid in advance shall be refunded to the Member.

 

RIGHT OF ACCESS AND INSPECTION

 

  1. The Member acknowledges that the Nasab Manager has access to the Premises for housekeeping and maintenance services.
  2. Suite Members agree to make the Suite available to the Nasab Manager or its agents for the purposes of inspection, making repairs or improvements, or to supply agreed services or in case of emergency.
  3. Except in case of emergency, the Nasab Manager shall give the Suite Member reasonable notice of intent to enter and for these purposes, twenty-four 24 hours notice shall be deemed reasonable.
  4. Suite Members shall not add, alter or re-key any locks to the Suite.

 

ASSIGNMENT

 

  1. Suite Members shall not assign, sublease or licence any interest in this Agreement.  Any assignment, sublease or licence shall, at the Nasab Manager’s option, terminate this Agreement.
  2. The Nasab Manager shall be entitled to assign its rights and obligations under this Agreement.

 

SEVERABILITY

 

  1. If any part of this Agreement shall be held unenforceable for any reason, the remainder of this Agreement shall continue in full force and effect.
  2. If any provision of this Agreement is deemed invalid or unenforceable by any court of competent jurisdiction, and if limiting such provision would make the provision valid, then such provision shall be deemed to be construed as so limited.

 

INSURANCE

 

  1. The Nasab Manager shall be responsible for maintaining appropriate insurance for the Premises, Facilities and Property. The Member understands that the Nasab Manager will not provide any insurance coverage for the Member’s, the Member’s Guests and/or Visitors’ property.
  2. The Member acknowledges and agrees that the Nasab Manager is not responsible nor shall be held liable for any loss or damage to items that belong to the Member, the Member’s Guests and/or Visitors or any other third party that are held or kept at the Premises irrespective of the cause of the loss or damage. Such responsibility is and remains with the Member and the Nasab Manager encourages the Member to obtain insurance coverage to protect against risk of loss or damage.

 

GOVERNING LAW AND JURISDICTION

 

  1. This Agreement shall be governed by and construed in accordance with the laws of the UAE as applied in the Emirate of Dubai. Each Party irrevocably agrees that the courts of the Emirate of Dubai shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this Agreement or its subject matter or formation (including non-contractual disputes or claims).

 

 

  1. ENTIRE AGREEMENT

 

  1. This Agreement constitutes the entire agreement between the Parties and supersedes any prior understanding or representation of any kind.   There are no other promises, conditions, understandings or other agreements, whether oral or written, relating to the subject matter of this Agreement.  This Agreement may be modified in writing by the Nasab Manager from time to time.

 

NOTICE

 

  1. Any notice required or otherwise given pursuant to this Membership shall be in writing, by email or delivered by courier at the address set out on the Membership Plan on page 1 of this Agreement.  Either Party may change such addresses from time to time by providing notice in writing.

VAT

 

  1. Each amount stated to be payable by the Member to the Nasab Manager under or pursuant to this Agreement is exclusive of VAT (if any).
  2. If any VAT is chargeable on any supply made by the Nasab Manager to the Member, the Member shall pay to the Nasab Manager an amount equal to that VAT.

 

NO WAIVER

 

  1. Failure of the Nasab Manager to insist upon the performance or observance of any of the terms of this Agreement shall not amount to a waiver of such breach or acceptance or variation by the Nasab Manager. Furthermore, no waiver by the Nasab Manager of any breach of this Agreement, express or implied, shall serve as a waiver of another breach of the same nature.

 

COUNTERPARTS

 

  1. This Agreement is executed in any number of counterparts each of which when executed and delivered shall be an original, but all the counterparts together shall constitute one and the same instrument.

 

FORCE MAJEURE

 

  1. The Nasab Manager shall not be held responsible for any delay in performance of any obligations under this Agreement where such delay is a result of an event of force majeure.

 

THIRD PARTY RIGHTS

 

  1. With the exception of the Affiliates, a person or entity which is not a Party to this Agreement shall not have any rights under this Agreement.

 

WEBSITE PRIVACY POLICY 

This Privacy Policy applies to all our systems. The app/ website may provide links to third-party sites for your convenience and information.  We do not control those sites or their privacy practices, which may differ from our own privacy practices. This Privacy Policy does not cover any personal data that you choose to give to unrelated third parties. We do not monitor or control the information collected by such sites or the privacy practices of any third parties, and we are not responsible for their practices or the content of their sites. 

 

WHAT PERSONAL INFORMATION DO WE COLLECT FROM YOU

 

We collect Personal Information relevant to the activity you choose to undertake with us, including: 

General correspondence 

If you correspond with us in any form, we will process and store your name and contact details and any query you might have through our contact form. 

 Resident details 

We process Personal Information, including your name, address, e-mail addresses and contact telephone numbers when you or the Company for which you work submit aapplication. We may also collect a variety of additional Personal Information from you, including your birthday, gender, qualifications, job title, company name and/or industry. 

Use of our Space 

We process Personal Information about your use of our Space, including location data for example, the times and dates of your access to our Space, who you are visiting or who is visiting you, events you attend and what Services you make use of. 

 

CCTV 

CCTV is installed at our Space to protect the safety of our Residents, employees, guests and their property, as well as to analyze the use of our Space. CCTV footage may be considered Personal Information and will therefore be handled in accordance with this Privacy Policy. In particular, recordings may be accessed by NASAB and may be shared with competent authorities or other interested third parties in accordance with applicable laws. The recordings are retained for a limited period of time but may be kept longer for the investigation of an incident or when competent authorities request us to retain them longer. 

 Use of our Website 

If you visit our Website, we collect some technical and statistical information about your use of our Website, including: 

  • your browser type and version, time zone setting, browser plug-in types and versions, operating system and platform (as applicable to the device you are using); 
  • information about your visit, including the website that referred you to our Website (if applicable), the path that you take through and from our Website (including date and time), pages that you viewed or searched for, page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), and methods used to browse away from the page; and 
  • we collect this information about you using cookies. Please refer to the section on Cookies below. 

This technical and statistical information is typically anonymous but may identify you in certain circumstances (“Technical Data”). Where it does, we treat it as Personal Information.

  • Complete a membership, virtual office or dedicated desk agreement 
  • Complete an event enquiry form or provide us with a signed agreement for a scheduled event 
  • Make an online enquiry using Nasab Website for any of the services we provide 
  • Sign in electronically as a guest when visiting one of our Events. 
  • Contacting a member of our team, whether by phone or email, to enquire about one of our services we provide or to make a booking 
  • Your email and contact information is available to other Community Members if you choose to be seen by the members from the App.

  • Photograph (members only) 
  • Debit/Credit card details

Note that we do not store card details on our web servers or NASAB App. These are only stored on Spreedly, a third party, server. Spreedly are responsible for protecting the security of card data (defined as a cardholder’s account number, expiration date and CVV2) in their possession and will maintain commercially reasonable administrative, technical and physical procedures to protect all the personal information regarding you that is stored in their servers from unauthorized access and accidental loss or modification. 

 

HOW DO WE USE THIS INFORMATION

We will use your personal information to provide you with services, products or information that you have requested and for administration purposes. We may need to share your information with our service providers for these purposes. We will not share your information with any external party for marketing or promotional purposes. 

 

HOW DO WE PROTECT YOUR INFORMATION

We hold personal data in a combination of secure online and offline computer storage facilities, and paper- based files. We take all reasonable technical and organizational precautions to prevent the loss, misuse or alteration of your personal data. We use a number of processes to protect your personal data including:

  • Computer passwords, firewalls and limited access to shared network drives by authorized staff only. 
  • Virus checking 

You are responsible for keeping the password you use for accessing our website confidential, and we will not ask you for your password (except when you log in to our website). We take all reasonable measures to protect our website and integrated email systems to ensure that un-authorized or unlawful processing of personal data, accidental loss or destruction of, or damage to, personal data does not occur.

We are required by law to hold your information for as long as is necessary to comply with our statutory and regulatory obligations.
